Staying in Compliance with Labor Law Posting Requirements

Adhering to labor law compliance regulations is crucial for employers to maintain a fair and legally compliant work environment while protecting the rights and interests of their employees. Labor law compliance encompasses various aspects, including minimum wage, overtime pay, working hours, workplace safety, anti-discrimination measures and employee benefits. Various federal and state agencies mandate employers display specific posters in the workplace to inform employees of their rights and protections. With over 56 state changes, two federal changes and over 20 states with mandatory changes already in 2024, keeping up with these regulations and posting them timely can be a daunting task. Failure to comply with these posting requirements can result in penalties, fines and legal consequences.
Complying with Labor Law Posting Requirements
If you have at least one paid employee, labor law posters are required to be posted at your place of business. In addition, every company with contracts with a federal government entity, regardless of its location, must post labor law posters related to serving as a federal contractor in addition to certain federal labor law posters. The U.S. DOL requires employers to post certain notices in their workplaces to ensure their employees have access to information about their rights. There are six posters required to be posted:
- Fair Labor Standards Act (FLSA) Minimum Wage Poster
- Occupational Safety and Health Act (OSHA Poster)
- Equal Employment Opportunity (Know Your Rights: Workplace Discrimination is Illegal Poster)
- Uniformed Services Employment and Reemployment Rights Act (USERRA Poster)
- Employee Polygraph Protection Act (EPPA Poster)
- Family & Medical Leave Act (FMLA Poster)

Posting Your Labor Law Posters
Ensure compliance by prominently displaying applicable labor law notices for easy employee visibility and access. Employees must post labor law posters in a conspicuous place accessible by all employees at every one of their facilities. Often, the best place to post labor law posters is in the breakroom or another common area. Depending on the size of the facility and workforce, this may mean a company must display posters in multiple areas. In cases where employers work with a large remote workforce, employers can share the documents digitally, so long as they notify employees if the law changes by email and send a copy of, or share a link to, the updated poster.
