DHS Issues Eighth Extension of Temporary Requirements for Form I-9 Compliance

The Department of Homeland Security (DHS) recently announced another extension of the temporary requirements allowing for the flexibility of Form I-9’s physical presence requirements through the U.S. Immigration and Customs Enforcement (ICE). DM Payroll Solutions explores the additional extension and what employers should know about Form I-9 reporting in the near future.

More on the Temporary Requirements

The temporary requirements were first implemented in Mar. 2020 in response to the COVID-19 pandemic and the resulting inability of many companies to work in-person safely. Since then, there have now been eight extensions of the regulations to accommodate the ever-changing workplace. Same as the other extensions, this new one only applies to businesses who are operating remotely, and it is set to expire Mar. 31, 2021.

E-Verify Participants

According to the U.S. Citizenship and Immigration Services (USCIS), E-Verify users who are eligible and opt to use the remote inspection option should continue adhering to the current guidance. They are also recommended to create cases for new employees within three business days of their hiring date.

Additional Extensions?

If the past year is any indication, it is probable for more extensions in Form I-9 temporary requirements ahead. DHS will continue to report any new guidance as necessary as the U.S. continues to fight the pandemic.
